How do I figure the appropriate amount?

by Lisa
(Huntsville,Tx , USA)

My ex husband and I divorced in 1997. I was supposed to receive 1/2 of his 401K program at that time. Unbeknownst to us, his company did not finalize the paperwork and the money is still in his name. The company has changed investment brokers and noone seems to know how much I am entitled to. The company has told my ex and I to get attorneys and get it worked out. My ex has offered to buy me out. the amount in 1997 was $2500. How do I figure the appropriate amount? I have found the company with which the largest percentage of the company's holdings are in and charted their growth/loss by year. When I apply this to these figures, I come out with approx. 13,000.00. Is this an appropriate approximation?
The company's gains and losses by year are:
1998 +.12
1999-.75
2000+.44
2001+1.15
2002+.48
2003-.12
2004+.56
2005+.04
2006+.33
2007-.24
2008+.37
2009+.89
2010+.19 (Januaryof2010)
